Public record
The documented corporate resolutions
On 24 May 2022, the US Department of Justice announced that Glencore International A.G. had pleaded guilty to Foreign Corrupt Practices Act violations and that Glencore Ltd. had pleaded guilty in a separate commodity-price manipulation matter. The announcement described agreements totalling more than $1.1 billion to resolve the US investigations. [1]
The price-manipulation account concerned fuel-oil benchmarks used in physical contracts and derivative positions. The DOJ described bids and offers intended to influence benchmark assessments, which in turn affected contract pricing. These are attributed descriptions of the historical corporate resolutions, not findings made by 365 ALTERAM. [1]

Why the payment trail is only one layer
Our investigative lesson is that a payment becomes meaningful only when connected to the surrounding commercial mechanism. A forensic review should identify the contract, pricing formula, performance obligation, relevant decisions and persons with authority. A correctly recorded payment may still require explanation; an unusual payment is not, by itself, proof of a criminal purpose.
In a benchmark-linked transaction, the reviewer needs to separate the commercial agreement from the events used to calculate its price. That creates two related timelines: what the contract required and what happened during the relevant pricing period. Treating them as a single unexplained invoice risks missing both incriminating context and legitimate explanations.

Build a transaction map that can be challenged
A proportionate review starts with lawfully obtained contracts, amendments, pricing notices, trade records, communications and payment evidence. Record which version of a document applied at each decision point. Tie amounts to counterparties and dates rather than relying on an aggregated total whose underlying entries cannot be reproduced.
For intermediary arrangements, compare the stated service with the actual work product, approval route and remuneration. Identify what the available record shows about knowledge, instructions and benefit for each relevant person. A corporate relationship, job title or copied email is a starting point for a question, not a substitute for individual attribution.
Where market behaviour or valuation requires specialist expertise, define the expert question before commissioning the analysis. The investigator should not turn a transaction chronology into a technical market opinion without the necessary competence. Any alternative commercial explanation should be tested against the same source material.

Keep findings, admissions and unresolved questions separate
A corporate guilty plea should not be presented as proof of every allegation against every individual connected with a business. Separate the entity and conduct covered by the source, the procedural status described in it and the person whose conduct is now under review. Do not import a conclusion from one proceeding into another without a supported basis.
The practical output is a source-indexed transaction map, a decision chronology and a schedule of discrepancies and unanswered questions. Counsel can then assess the legal significance of a record whose strengths and limitations are visible. The objective is a defensible account of the evidence, not a narrative selected in advance.
