Historical focus: WS v. Bundesrepublik Deutschland, C-505/19, judgment of 12 May 2021, with procedural background recorded in the Advocate General's opinion of 19 November 2020. Sources checked on 24 October 2026. This is not a report on WS's present position or all later case law. The judgment's EU and Schengen conditions are not worldwide rules. The investigative workstream below is our own analysis, subject to applicable law and qualified counsel's direction.

Public record
The public case: a ruling with defined conditions
In WS v. Bundesrepublik Deutschland, the Court of Justice of the European Union considered a US-requested Red Notice concerning a German national. Earlier German proceedings had been discontinued following payment under a settlement procedure. The dispute raised whether the same acts had already been finally dealt with. [1]
On 12 May 2021, the Court explained the significance of a final judicial decision establishing that the prohibition on repeated proceedings, ne bis in idem, applied. Under the EU and Schengen provisions examined, provisional arrest was not precluded while that remained unestablished. This conditional ruling was not a worldwide immunity from arrest. [1]
The chronology also needs care: the Advocate General's account records that INTERPOL deleted the notice on 5 September 2019 at the US authorities' request, before the 2021 judgment. That factual account must be distinguished from the Advocate General's proposed legal conclusions. The case should not be presented as a 2021 court order deleting a still-active notice. [2]

The forensic question: what history does the alert summarise?
An international alert compresses a much longer procedural history. Our methodological lesson is to reconstruct that history before assessing the proposition being circulated. A short account of an alleged offence may omit the precise scope of an earlier decision, a condition attached to it or a distinction between separate episodes.
Begin with a source register: the available notice or diffusion, underlying warrant or judicial order, charging documents, decisions and subsequent communications. Record who issued each document, when it took effect and what it actually says. Distinguish an authenticated decision from a client's recollection, a translation or an informal summary. Include evidence of compliance with any condition attached to a decision, and flag whether a document establishes finality or simply records an intermediate procedural step.

Compare the facts rather than the labels
Where earlier proceedings may be relevant, build a comparison of persons, conduct, transactions, dates and locations. Similar offence names do not establish that two procedures concern identical events. Conversely, different legal descriptions may refer to overlapping conduct. The investigator documents the factual comparison; qualified counsel assesses its legal significance.
A clearly labelled hypothetical illustrates the problem. An earlier decision concerning one payment does not, without further examination, resolve allegations about a series of later transfers. The report should identify the exact overlap, the differences and any missing documents. This protects the review from overstating both the allegation and a potentially favourable prior outcome.
Public record
Separate the cooperation request from national action
INTERPOL explains that a Red Notice requests location and provisional arrest pending extradition, surrender or similar action; it is not an international arrest warrant. Member countries apply their own laws when deciding whether to arrest. [3] The CCF's published FAQ separately explains that its role concerns compliance with INTERPOL's rules and that it does not assess extradition outcomes. [4]

Verify developments without assuming their reach
Create separate entries for the status of the underlying national process, the international cooperation record and any relevant domestic measure. If a document records withdrawal, amendment or discontinuance, identify exactly what changed and the evidence confirming it. Do not silently extend a decision about one record to every connected procedure.
Test adverse possibilities as carefully as favourable ones. A decision may be limited, conditional or directed at different facts. Equally, an outdated description may fail to reflect a material development. Mark unresolved status questions explicitly and prioritise authorised enquiries that could change the assessment. A strong dossier makes uncertainty visible and gives each important conclusion a verifiable source.

Give counsel a dossier that answers specific questions
The practical deliverable is a procedural chronology, a comparison of the underlying facts and a schedule of discrepancies supported by indexed documents. Identify translation limitations, unavailable records and contrary evidence. Explain which question each proposed further enquiry would resolve, rather than submitting an undifferentiated collection of papers.
