Public record
The public record: a substitute witness and an unresolved question
In Smith v. Arizona, an analyst examined suspected drugs and recorded her findings. A different analyst later testified using those records. The Supreme Court held that factual assertions supporting an expert opinion are introduced for their truth when that support depends on their accuracy. Calling them the basis of an opinion does not remove that issue. [1]
The Court vacated the judgment and remanded. It left the testimonial character of the statements, including a procedural forfeiture question, for the state court. This was neither an acquittal nor a finding that the chemical testing was wrong. The official docket records the subsequent mandate and return of the record. [1][2]

The forensic question: what has really been verified?
A narcotics prosecution may contain an impressive report, an experienced witness and a confident conclusion. Independent review starts by separating three propositions: the tested material contained a particular substance; that material came from the relevant exhibit; and the accused knowingly participated in the alleged conduct. Establishing one does not automatically establish the others.
The methodological lesson we draw from Smith is about dependencies. A reviewer should identify which observations the witness made personally, which came from another person, and which conclusions depend on untested assumptions. Reinterpreting an existing result, repeating a measurement and independently checking the original process are different activities. Counsel needs to know which activity actually occurred.

Follow the exhibit before interpreting the instrument
Begin with a traceable exhibit map. Connect seizure identifiers, photographs, packaging descriptions, laboratory receipt numbers, subsample references and reported results. Record transfers, opening and resealing events where documented. If identifiers change, establish the documentary bridge rather than assuming that similar descriptions refer to the same material.
This exercise must remain proportionate. A clerical discrepancy may have an adequate explanation. A missing signature alone does not establish contamination or substitution. Conversely, an unexplained mismatch affecting the tested item cannot be repaired simply by repeating the final conclusion. Classify each issue by what it could change and what evidence could resolve it.

Ask for the evidence behind the conclusion
Our proposed review workstream distinguishes the final report from the material needed to examine its reasoning. Subject to lawful disclosure and specialist advice, relevant material may include contemporaneous notes, instrument outputs, processing settings, quality-control records, applicable procedures and documented departures. Preserve originals and describe exactly what was supplied, withheld or unavailable.
An appropriately qualified analytical specialist can then assess whether the available records support the stated identification and its limits. Questions about sampling, quantity and purity should be addressed separately when material to the allegation. A conclusion about one tested portion should not silently become a conclusion about every package without a defensible basis.
SWGDRUG publishes minimum recommendations for seized-drug analysis; its approved-recommendations page identifies Edition 8.2 dated 27 June 2024. [3] These provide a professional reference point, not a universal rule of admissibility or a substitute for examining the laboratory procedure applicable at the relevant time.

Chemical identity does not establish knowledge
Even reliable identification leaves other evidential questions open. In an international shipment case, a separate review may examine access to the consignment, document provenance, communications, payment authority and the chronology of handling. Keep the chemical findings distinct from propositions about possession, knowledge, control and participation.
Test competing explanations against the same evidential standard. The records may strengthen the prosecution account, reveal a material weakness, or leave the issue unresolved. A useful independent report includes adverse findings and explains uncertainty. Its purpose is to make the evidential position clearer, rather than to manufacture doubt.

What the defence team should receive
The practical deliverable is a source-linked exhibit chronology, a dependency map of the expert conclusions, a prioritised discrepancy schedule and focused questions for disclosure or specialist examination. Each issue should identify its potential significance, the available contrary material and the limits of the proposed test.
For defence lawyers and defendants facing serious international narcotics allegations, early review creates time to secure records and evaluate technical questions before trial. 365 ALTERAM offers independent forensic review and counter-investigation support, with appropriately qualified specialists where required. Qualified counsel retains legal strategy and jurisdiction-specific advice. No review guarantees a particular outcome. Before You Trust the File, Test It.
