The Peter B. appeal: why the evidence behind the sentence and the €83 million claim must be tested

The Boomtomaat proceedings show why criminal responsibility, technical compliance and alleged unlawful benefit require separate scrutiny. 365 ALTERAM sets out a focused independent-review framework for the defence.

Public-case analysis

Reviewed 29 October 2026. The October 2026 appeal demand is attributed to Quote's headline and publicly indexed author-page excerpt; the full article and appellate submissions were unavailable. Background: official July 2023 court summary and the text of ECLI:NL:RBNHO:2024:13413, reproduced by PONT. No appellate determination is asserted here. 365 ALTERAM has not examined the private file and does not claim an instruction from Peter B. or his lawyers.

Public record

A prosecution demand is not an appellate judgment

Quote's 22 October 2026 report, as reflected in its headline and publicly indexed author-page excerpt, describes a prosecution request on appeal for three years' imprisonment, including one year suspended, against the former fats-processing entrepreneur identified as Peter B. The headline also refers to approximately €83 million in alleged unlawful benefit. These are reported prosecution positions, not a new court ruling. The complete appellate submissions have not been reviewed. [1]

The official July 2023 court summary provides essential context. The Noord-Holland District Court imposed a one-year suspended prison sentence, 240 hours of community service and a €276,250 fine on the principal defendant. It found environmental and document offences involving companies under his direction, but acquitted on other allegations, including participation in a criminal organisation. It described a group whose activities were predominantly lawful. [2]

Public record

The financial proceedings already demonstrate the importance of method

In its separate confiscation judgment of 23 December 2024, ECLI:NL:RBNHO:2024:13413, the court recorded an original claim of €83,271,074, subsequently adjusted. It estimated unlawful benefit at €12,997,498.74 and imposed a payment obligation of €12,987,498.74 after a time-related reduction. Those are distinct figures and a separate decision from the criminal sentence. [3]

The judgment rejected treating the biodiesel company's entire business result as unlawful benefit. It examined the appropriate hypothetical lawful situation and calculations by offence, including a defence-commissioned report. But it did not accept every defence scenario, and it attributed benefit to the individual defendant through the corporate structure. This was a substantial financial order, not an exoneration. [3]

The difference between the prosecution's earlier claim and that judgment must not be described as a prison-term reduction. Nor can the 2024 calculation be assumed to determine the outcome of the reported appeal. [3]

365 ALTERAM analysis

A strong counter-investigation starts with the questions the court must decide

For a defence team in a case of this kind, 365 ALTERAM can provide structured independent investigation linking technical operations, contemporaneous documents and financial consequences. Strength comes from reproducible findings that address the disputed propositions. It cannot come from declaring the defendant innocent without examining the file.

Counsel should first identify which findings are challenged, which offences and periods remain in issue, and what the prosecution relies upon for imprisonment and confiscation respectively. Build a proposition register connecting each assertion to its source, contrary material and the next test. A general objection to an enormous dossier is less useful than a precise challenge to a decisive assumption.

Reconstruct the batches and examine the technical evidence

Map the relevant incoming materials, tank movements, production batches, processing records, laboratory samples and outgoing deliveries. Reconcile quantities across weighbridge records, invoices and stock systems. Identify where a batch connection is demonstrated and where it has merely been inferred. Preserve originals, metadata and the history of later adjustments.

Appropriately qualified process and laboratory specialists should examine sampling, chain of custody, measurement uncertainty and the applicability of results to the batches alleged. Separately reconstruct the operating conditions and the requirements applicable at the relevant time. A possible safety argument does not automatically establish regulatory compliance; a regulatory breach should likewise not be translated into a scientifically unsupported claim about actual harm.

The 2023 court summary itself distinguished breach of biodiesel processing rules from the possibility that the process nevertheless achieved sufficient safety. That distinction warrants careful examination by specialists and counsel, rather than an assumption that either issue disposes of the other. [2]

Rebuild the benefit calculation and individual decision chronology

A forensic accountant should reproduce the calculation from underlying records and separate revenue, margin, avoided costs, intercompany transfers and personal benefit. Model legally relevant alternatives identified with counsel, documenting feasibility, costs and uncertainty. A hypothetical lawful scenario needs evidential support: it cannot rest on assuming an approval, production capacity or alternative market that was unavailable.

Examine individual responsibility through instructions, warnings, authorisations and actual decision-making. The trial court's findings concerning ignored employee warnings must be addressed directly, not omitted from a defence narrative. A proper review tests complete communications, their timing and context alongside evidence supporting or limiting the alleged role. [2]

These workstreams should produce a batch chronology, source-indexed discrepancy schedule, reproducible financial model and clearly scoped expert questions. Findings that confirm the prosecution's case belong in the report alongside those that challenge it.

What a defensible intervention can achieve

Material corrections can support counsel's submissions about proof, individual responsibility, the seriousness of conduct or the amount recoverable. Whether they affect a sentence or confiscation order depends on the applicable law, procedural scope and the court's assessment. There is no automatic conversion from a lower financial figure to fewer months in prison.

365 ALTERAM can offer Peter B.'s defence team an independent, multidisciplinary review within an agreed instruction and lawful access to the material. The objective is a complete evidential account capable of supporting a different conclusion where the facts justify one. In a case carrying both imprisonment and a potentially life-changing financial claim, testing the file is a concrete defence necessity.
