White-collar crime in Dubai: why forensic scrutiny matters when years of liberty are at stake

A serious financial allegation needs more than a large headline figure. Independent forensic work can test the transactions, loss calculations and individual responsibility on which a criminal case and its sentence depend.

Public-case analysis

Historical example: DFSA corporate enforcement against Abraaj in July 2019 and its January 2023 announcement of the Financial Markets Tribunal decision concerning Arif Naqvi. These are regulatory proceedings, not Dubai criminal sentencing decisions. Sources and later-development searches reviewed on 26 October 2026. This article does not report the current status of separate criminal proceedings or claim 365 ALTERAM involvement.

The evidential problem behind a major financial case

For a person facing a white-collar prosecution in Dubai, the decisive question is what the evidence establishes about their own conduct. A large corporate loss, an alarming account balance or a senior title cannot answer every question about knowledge, intent and responsibility. When a lengthy prison sentence is at stake, those distinctions demand rigorous examination before the court decides the case.

Independent forensic investigation can identify an inaccurate calculation, expose missing context or establish that the record supports a narrower account of participation. Those findings may support a different charging or sentencing assessment. Their value comes from demonstrable corrections to the evidence, not a promise to remove a predetermined number of years.

Public record

Abraaj: a Dubai regulatory example, with clear limits

On 30 July 2019, the Dubai Financial Services Authority announced penalties of USD 299,300,000 against Abraaj Investment Management Limited and USD 15,275,925 against Abraaj Capital Limited. The DFSA described unauthorised financial services, misleading investors and misuse of investor funds. Its account included temporary borrowing around reporting dates that created misleading impressions of available cash. These were regulatory findings concerning the specified entities. [1]

On 3 January 2023, the DFSA announced that the Financial Markets Tribunal had upheld its action against founder Arif Naqvi in a decision dated 12 December 2022. This included a USD 135,566,183 financial penalty and restrictions on functions in or from the DIFC. The DFSA attributed specific decisions and communications to him. [2]

Neither announcement is a Dubai criminal judgment imposing or reducing imprisonment. Their relevance here is methodological: financial reporting, underlying cash movements and personally attributable decisions require separate examination. A regulatory penalty cannot be presented as criminal loss or a prison sentence. [1][2]

Reconstruct the economic reality behind the entries

Start with a transaction map connecting each material payment to its account holder, contract, invoice, approval and ultimate recipient. Reconcile original bank records with the accounting ledger and supporting communications. Distinguish an intercompany transfer from external revenue, a temporary borrowing from unrestricted cash, and an accounting entry from money actually received.

Examine the reporting period as well as the reporting date. A bank balance at one moment may be accurate while providing an incomplete picture of liquidity. Compare preceding and subsequent movements, restrictions on funds and relevant repayment obligations. Test both legitimate commercial explanations and evidence of concealment against the same complete record.

Preserve original exports and document exchange rates, time zones, data transformations and missing records. Where Arabic and English documents coexist, qualified translation and consistent entity identification matter. A translated summary or spreadsheet should remain traceable to its source. Unsupported certainty is especially dangerous when records cross languages and jurisdictions.

Test loss and responsibility independently

A forensic accountant should explain precisely what the alleged financial figure measures. Gross turnover, outstanding debt, investor shortfall, personal benefit and recoverable assets are different categories. Identify duplicated transactions, repayments and timing differences, then ask counsel which items matter under the applicable offence and sentencing rules. A smaller total is useful only if it corrects a legally relevant proposition.

Reconstruct the individual's authority and actions during the charged period. Who controlled the account, instructed the transfer, approved the disclosure or knew the purpose of the payment? Compare mandates and job descriptions with actual communications and system records. A signature may be powerful evidence, but its meaning depends on the document and surrounding facts.

Independent examination must also report adverse results. Records may confirm deliberate deception or reveal greater involvement than the initial file suggested. An expert who suppresses those findings undermines the credibility of the entire review. Defence usefulness and professional independence depend on transparent methods and conclusions that withstand challenge.

How forensic findings can influence a long sentence

Where supported by the evidence and applicable law, corrected findings may change the conduct attributed to the accused, the financial consequences established or the assessment of their role. Depending on the procedural stage, that can support a narrower case, an acquittal on an unsupported allegation or a different sentencing outcome. It does not establish an entitlement to leniency or guarantee that imprisonment will be reduced.

Dubai-based criminal counsel should define the legal questions, relevant jurisdiction, deadlines and procedural route. A forensic team supplies reproducible analysis rather than substituting a foreign sentencing model or regulatory decision for UAE criminal law. Early instruction gives counsel time to seek missing material and challenge assumptions before they harden into findings.

365 ALTERAM supports defence teams through financial reconstruction, digital evidence review and independent examination of individual responsibility. The deliverable should connect every material conclusion to its sources and limitations. When a person's future may be measured in years behind bars, the file deserves more than acceptance at face value: it deserves to be tested.
