Public record
A pharmaceutical scandal with distinct legal outcomes
In June 2019, the US Department of Justice announced a $225 million criminal and civil resolution concerning Insys Therapeutics and its marketing of Subsys, a fentanyl product. The arrangements included a deferred prosecution agreement for the parent and a guilty plea by its operating subsidiary. Of the total, $195 million concerned settlement of civil False Claims Act allegations; the criminal fine and forfeiture were separate. The headline settlement figure was not a judicial finding of criminal loss against every executive. [1]
In January 2020, founder John Kapoor received 66 months in prison after a jury convicted him of racketeering conspiracy. Prosecutors had recommended 15 years. That difference does not establish that an expert intervention reduced an existing sentence. [2]
In August 2021, the First Circuit upheld the jury verdicts in full and affirmed the unchallenged prison sentences, while vacating restitution and forfeiture orders and remanding for further proceedings. Financial consequences and convictions required distinct legal analysis. [3]

Accountability requires an accurate evidential foundation
Large-scale pharmaceutical fraud deserves serious investigation. Patient safety, public funds and trust in medicine are substantial interests. The same seriousness demands scrutiny of the evidence used to imprison an individual. A corporate scandal cannot answer every question about a particular person's knowledge, conduct or responsibility.
Independent counter-expertise is a disciplined re-examination of the material underlying an allegation. Its purpose is to establish what the evidence can sustain. A credible expert must report findings that strengthen the prosecution as clearly as findings that weaken it. Disagreement without a reproducible method adds little.

Reconstruct the claim before accepting the total
Start with the pathway from prescription to reimbursement. Connect the patient record, relevant product information, prescribing decision, authorisation request, statements to the insurer and actual payment. Preserve dates, document versions and the identities of the people responsible for each step. Missing records must remain visible as limitations.
Then test the financial model. Does a spreadsheet include rejected claims, reversals or duplicate entries? Does it distinguish gross sales, receipts, alleged loss, benefit and settlement amounts? Which transactions fall within the charged period and the conduct attributed to this defendant? These categories cannot simply be substituted for one another; counsel must identify the applicable legal measure.
A reviewer should also explain sampling and extrapolation. A finding within one selected group does not automatically establish the same result across every prescription. Show the population, selection method, exclusions and uncertainty, then test whether a different defensible assumption materially changes the calculation.

Separate clinical questions, causation and individual responsibility
Product approval, clinical appropriateness, reimbursement eligibility and the truth of an insurance submission are related but different questions. Each needs appropriate expertise and supporting records. A commercial-data analyst should not convert a prescribing pattern into an unsupported medical opinion. Where injury or death is alleged, appropriately qualified specialists must examine the proposed causal connection and competing explanations.
Individual attribution requires another reconstruction: who knew what, when, and what could they actually control? Compare authority records, instructions, communications and transaction timing. A senior title does not complete that analysis. Equally, a narrowly worded job description cannot override evidence of actual participation. The task is to test both propositions against the complete record.

When the difference could be years of liberty
Where a prosecution carries potential exposure measured in decades, a material correction to the evidence can have profound consequences. Depending on the jurisdiction and procedural stage, substantiated findings may support a different conclusion about a charge, the scope of attributable conduct, a financial calculation or an aggravating allegation. Those differences can affect sentencing. There is no universal formula converting an accounting correction into years saved.
Nor does the Insys record prove that counter-expertise saved anyone ten or twenty years. The defensible point is that conclusions affecting liberty should survive independent testing. An expert report needs a source index, transparent calculations, competing hypotheses, uncertainty and clear boundaries of competence. Counsel determines how its findings can properly be used.
At 365 ALTERAM, our forensic review work supports counsel in reconstructing transactions, decisions and individual roles in complex white-collar cases. The priority is to identify the questions requiring investigation early and engage the relevant specialists. When decades of a person's life may be at stake, an untested assumption is too consequential to leave unexamined.
