Fictional case 03 · White collar crime forensic review
The finance director and the disputed commission
United Kingdom, United Arab Emirates and Singapore
The allegation
A finance director is accused of organising a bribery scheme after approving payments to an overseas consultant. The prosecution combines twelve transfers into one alleged criminal arrangement and relies on the director's job title to infer control over procurement. The director maintains that every payment concerned legitimate market-entry work.
The independent investigation
365 ALTERAM reconciles contracts, deliverables, approval records, bank statements and contemporaneous communications. Nine payments correspond to documented services approved through ordinary procedures. Two lack sufficient supporting material and remain unresolved. For the final payment, a recovered instruction shows that the director knowingly approved an undisclosed benefit to an intermediary linked to a purchasing official. The review records this adverse evidence without dilution. An authority matrix also shows that another executive selected the consultant and controlled negotiations; the finance director did not direct the entire procurement operation.
The hearing and fictional outcome
Counsel uses the report to contest the alleged scope of the scheme while addressing the damaging instruction. In the fictional judgment, the court rejects the allegation that the director managed all twelve payments as a coordinated bribery programme. It nevertheless convicts him in relation to the substantiated improper payment. Its sentencing reasons distinguish his proved conduct from the wider scheme alleged against him.
The principle in practice
A complete defence investigation may narrow responsibility while confirming an offence. Hearing both sides enables a decision grounded in individual conduct, rather than a person's position on an organisation chart.
Forensic deliverable
A payment reconciliation, authority matrix and findings schedule separating supported and unresolved allegations.
What this illustration demonstrates
Independent examination must record what supports the allegation, what challenges it and what remains unresolved. 365 ALTERAM supports counsel with source-linked findings and specialist coordination; the competent authority determines the legal consequences.
