Fictional case 07 · War crimes investigations and forensic review

The commander identified in a recycled video

Two fictional neighbouring states and proceedings in Europe

The allegation

A former officer is accused of ordering an attack on civilians. A widely circulated video is presented as showing the officer near the scene shortly before the attack. Translated witness summaries also describe an instruction allegedly given by him. The alleged harm is grave, and the prosecution treats the video, summaries and command chart as mutually reinforcing evidence.

The independent investigation

365 ALTERAM coordinates a review of the earliest available video copies, landmarks, event records, original interviews and command documents. The video can be placed at a different location and predates the incident, although it does show the officer. A qualified linguist finds that a witness described an instruction attributed to an unnamed superior; the summary identifies that superior as the accused without explaining the inference. The command records place the officer within the wider organisation, but leave effective control over the unit at the relevant time unresolved. Other evidence supports that civilians were attacked. The review does not treat uncertainty about the accused's role as uncertainty about all reported harm.

The hearing and fictional outcome

In the fictional proceedings, the court receives the provenance analysis and hears the competing experts. It requires further evidence on identification, command authority and the alleged order before determining individual responsibility. Its reasons address each disputed link separately and reject the proposition that three records necessarily provide independent corroboration when they repeat the same attribution.

The principle in practice

The seriousness of an allegation makes accurate individual attribution essential. Defence participation must permit examination of original sources, translations and dependencies between reports while respecting witnesses and victims.

What this illustration demonstrates

Independent examination must record what supports the allegation, what challenges it and what remains unresolved. 365 ALTERAM supports counsel with source-linked findings and specialist coordination; the competent authority determines the legal consequences.
